Bryan Kohberger’s legal team was expected to attend a closed hearing at a distance Wednesday to present arguments to the judge on several proposals.
Kohberger, 30, is charged with Four counts of first -degree killing and a case of gross burglary. He is accused of mortally stabbing the University of Idaho student Madison Mogen, Kaylee Goncalves, Xana Kernodle and Ethan Chapin in a residence outside Campus in Moscow in 2022.
In a message to the hearing, the defense said it would make oral arguments in support of ex-partial requests in front of district judge Steven Hipler, who leads the case. An ex -part exercise is a legal request made before the court of one party without the other being present.
The announcement stated that the consultation would be held at 1 p.m. 14.30 local time Wednesday or as soon as hippbles become available after this time. The content of the ex-parties is unclear.
Defense submitted a proposal On November 26 to seal the Defense’s changed memorandum and exhibitions that support a Franks hearing. A Franks hearing is held to determine if a statement used to obtain a search order contains accurate information.
Anne Taylor, Kohberger’s lawyer, said she filed the request because “the documents contain facts or statements that can threaten or jeopardize the lives or security of individuals.”
She said that sealing the documents would help secure Kohberger’s right to a fair trial and that the detection of the information would create “an unjustified violation of privacy.”
The prosecution did not object to the proposal.
Hipplers ordered the defense to change the note. He said the defense submitted 38 exhibitions amounting to over 2,000 pages.
“Unfortunately, the defendant’s note fails to a large extent to identify the relevant parts of the exhibition items, rather than simply referring to the exhibition number without identifying the exact pages referred to,” Hippler said. “Thus, the court is left with the unwavering task of searching the sides and sides of virtually irrelevant documents to determine which part the defendant had to refer to.”
Kohberger’s trial is scheduled to begin on August 11, 2025, with the election of jury on July 31st. The next hearing in the case is scheduled for January 23rd.
Kohberger Remains in Custody at There is county prison in Boise and awaiting trial. He risks the death penalty if convicted.
The defense raised several objections to the death penalty, including the state’s criteria for the death penalty, changed public opinion and international law. Hipplers rejected all the defense’s arguments on November 20.
